Procedures & Fines

In general, the maximum fine or penalty for violation of an ordinance, resolution or regulation of a city may not exceed $1,500 and the term of imprisionment may not exceed 30 days. [N.D.C.C. 40-05-06(1)]

Except for those violations listed under N.D.C.C. 39-06.1-05, a city may establish a fee for ordinances that regulate the operation or equipment of a motor vehicle at up to twice the fee established for a similar violation under N.D.C.C. 39-06.1-06 [40-05-06(2)].

A municipal judge may impose alternate sanction in lieu of a fine of jail. A municipal judge may also enter a deferred or suspended sentence. [N.D.C.C. 40-05-06(4)]

The sentence for contempt of court may not exceed a fine of $1,500 and 30 days in jail. [N.D.C.C. 40-18-14]
